The Data Protection Supervisor Measure No. 229 of 8 May 2014, published in the OJ No. 126 of 3 June 2014, has categorised cookies into two macro-categories: “technical” and “profiling” cookies.
Technical cookies are those used for the sole purpose of “sending a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information service explicitly requested by the subscriber or user to provide this service “(see Article 122, paragraph 1, of the Code).
They are not used for other purposes and are normally installed directly by the owner or operator of the website. They can be divided into navigation or session cookies, which guarantee normal navigation and use of the website (allowing, for example, to make a purchase or authenticate to access restricted areas); analytics cookies, assimilated to technical cookies when used directly by the website operator to collect information, in aggregate form, on the number of users and how they visit the website; functionality cookies, which allow the user to navigate according to a series of selected criteria (for example, the language, the products selected for purchase) in order to improve the service provided. Consent of users is needed before installing these cookies.
Profiling cookies are aimed at creating user profiles and are used in order to send advertising messages in line with the preferences expressed by the same in the context of surfing the net. Due to the particular invasiveness that these devices may have in the private sphere of users, European and Italian legislation provides that the user must be adequately informed on their use and thus express their valid consent.
They refer to Article 122 of the Code where it provides that “the storage of information in the terminal device of a contractor or user or access to information already stored are only allowed on condition that the contractor or user has given his or her consent after being been informed in the simplified procedures referred to in Article 13, paragraph 3 “(Article 122, paragraph 1, of the Code).
In the same Measure, the Data Protection Supervisor has also categorised cookies according to the subject who operates as data controller collected by the cookie, distinguishing between first-party cookies and third-party cookies.
These are cookies managed by the website owner. For these cookies, the disclosure obligation lies with the website owner. The latter also has an obligation to indicate how to block the cookie.
These are cookies managed by a third party other than the website owner. For these cookies, the obligation of the information and indication of the methods for the possible blocking of the cookie rests with the third party, while the website owner is obliged to insert the link to the third party’s website on the website where these elements are available.
In both types of cookies (first-party or third-party) the consent, necessary if the cookie is a profiling cookie, is collected through a special banner on the website’s home page.
